User Agreement and Terms and Conditions

Our business a licensed travel agent NT 094 provides an online facility where the client/customer can compare multiply vehcile selections available to us by established 4WD, campervan, motorhome companies and businesses within Australia. All vehicle specifications, images, lists of inclusions and terms and conditions are proved solely by the rental companies and business offering those vehicles and may change at any time without notice. All vehicle information is presented in a clear and simple way that enables for easy comparsion for the client/customer.

Images are for illistration purposes only and may vary from the actual vehicle provided. As vehicles may be upgraded or changed at any time the images may not show all variations within a vehicle category.

Contract/Agreement: The contract is between Australia 4 Wheel Drive Rentals an Australia business ABN No: 54 561 356 425 incorporating the web site www.australia4wheeldriverentals.com, www.sydneymotorhomes.comand www.australia4wdrentals.com - either operator or agent - and any person (client) travelling or intending to travel on an itinerary or tour supplied. This agreement shall be interpreted in accordance with the law of Northern Territory in the Commonwealth of Australia. The actions, claims, demands or suits arising out of this agreement shall be exclusively justiciable in the courts of the said state. Australia 4 Wheel Drive Rentals has the sole authority to vary or omit any of these terms.You will agree to verify the information with the provider of the service should you take any action after reading these pages.You will agree to indemnify Australia 4 Wheel Drive Rentals, it's staff, it's sub-contractors/agents and www.australia4wheeldriverentals.com and it's websites, and all other access providers that enabled you to access this site for all foreseeable and unforeseeable results of any actions you take based on the material contained in this site.

Booking requests are only accepted on the condition that Australia 4 Wheel Drive Rentals User Agreement and Terms and Conditions, and the terms and conditions that apply to the relevent rental vehicle have been read and understood, and that You Agree To Accept Them.

Australia 4 Wheel Drive Rentals takes all measures available to them to maintain the Terms and Conditions for the vehiocle rental supply businesses and companies and specifications for their vehicles are current and up to date but accepts no responsibility for changes made by supply companies that do not appear within this and all our web sites. Rental supply businesses and companies may also apply minimum rental terms during busy periods such as Chritmas and summer peak season, easter and school holidays and other selected event dates such as Bathhurst weekend.

Quotations: All quotations are subject to availability of vehicles and services quoted and are not guaranteed until the deposit or full amount whichever is quoted in the quotation of the selected vehilce is received and booking confirmed. Some quotations will have validity dates (refer to Smart Rates and Flex Rates) on them and if a deposit is not received by that expiry date then the quotation will automatically cancel without notification to you.

Calculation on vehicle hire: Suppliers we use and/or their agent 'Australia 4 Wheel Drive Rentals' will not honour calculation errors. Should a calculation error occur the supplier will charge for the shortfall at pickup. (this is part of the suppliers terms)

Bookings: To secure a booking, Australia 4 Wheel Drive Rentals requires a completed Booking Form by the client, or the parent/legal guardian (if the client is under 18 years) and payment details (credit card number, expiry date, name on card, address and contact details). A booking is valid from the date Australia 4 Wheel Drive Rentals confirms acceptance in writing and when Australia 4 Wheel Drive Rentals receives the client's returned confirmation section of the ticket signed by the client. Australia 4 Wheel Drive Rentals reserves the right to decline any booking at their discretion.

Payment: All payments will not be processed until the vehicle is confirmed as available.

A deposit or full payment of the daily basic rental (including if selected inclusive rates) will be required to confirm any booking. Deposit and Full Payment conditions for certain products may vary and we will advise you in writing of these conditions at the time of quotation.

1.) If your rental pick-up is within 45 days from the booking, Australia 4 Wheel Drive Rentals require full payment of the total daily basic rental or total inclusive daily basic rental charges. The client/customer is then to apy any applicable oneway fees, remote locations fees, excess or bonds, cleaning bonds, Airport fees, 2.5% Stamp Duty and Adminstration fees, Gas Bottle fees, any associated fees which may vary from supplier to supplier and optional extras direct to the supplier at pickup.

2.) If your rental pick-up date is 45 days or more from the time of booking, Australia 4 Wheel Drive Rentals require a deposit of $200.00 or (other nominated deposit amount please refer to your quote), with the balance of the total daily basic rental charges payable 45 days prior to pickup date. We will send a reminder email before the balance is due. We will then access the credit card detail supplied at booking for the balance of payment.

Credit Cards-Suppliers: Various suppliers now have an additional surcharge on any transaction. Please see your quote for details

Credit Cards-Australia 4 Wheel Drive Rentals: We accept Visa and Mastercard. Card Surcharge any Payment to Australia 4 Wheel Drive Rentals direct then the agent Australia 4 Wheel Drive Rentals will apply a 1.5 % surcharge for all credit card transactions.

A Rental Voucher will be emailed to you. Please check that all the details are correct. The Rental Voucher is only valid when the total balance has been processed. You are also required as part of these terms and Agreement to sign the 1st confirnmation page of the same Rental Voucher and fax, mail or scan this page to Australia 4 Wheel Drive Rentals within 72 hours.

Final Payment: In the case of non-payment of the balance by the due date, Australia 4 Wheel Drive Rentals will treat the booking as cancelled unless the client/customer communicates to the contrary.

Final payment conditions for certain products may vary and we will advise you in writing of these conditions at the time of quotation.Some operators will request the balance of payment only at pickup prior to travel. This will be advised of this in your quote by Australia 4 Wheel Drive Rentals if this is applicable.

Prices: All prices will be quoted in Australian Dollars. Please use a currency converter to check the cost. All prices include Australia Goods and Services Tax of 10% and New Zealand Goods and Services Tax of 12.5%.

Exchange Rate / Currency Variations: All credit card transactions are conducted in Australian dollars. Due to exchange rate fluctuations there could be some variance in the amount refunded compared to the amount initially charged. We do not accept any liability for variances up or down. Refunds by credit card can take up to 45 working days or more depending on the renter’s Financial Institution.

Cancellations: Must be in writing and can either be per email, facsimile, or by letter. No cancellation will be accepted unless received in writing, signed by the hirer and received by us directly from you. The date that we receive the cancellation notice is the date that it is deemed cancelled.

Cancellation Fees: The deposit less $75 administration costs will be carried forward towards future booking deposit made by Australia 4 Wheel Drive Rentals (this is at the sole discretion of Australia 4 Wheel Drive Rentals ) if cancellation is made more than 30 days prior to travel. Deposit will be held for 6 months from date of cancellation.

Each suppler varies in their terms and conditions. We supply you the client with the correct terms of the supplier when we quote your enquiry or ticket your booking based on the relevant suppllier. It is part of the booking requirements that you read, understand and accept the suppliers terms and conditions.

Refunds will not be made for bookings cancelled due to inclement weather. We strongly recommend that you take out travel insurance, including cancellation insurance and effects of Force Majeure !

Important Please Note: There is no refund for late pick up or early dropoff or return of vehicle for any reason whatsoever and the full cancellation policy is effected by all suppliers.

Here are the following Major Suppliers Cancellation Fees not including Australia 4 Wheel Drive Rentals fees (excluding agents adminstration fee and deposit). For the Cancellation Fees applicable for your booking please refer to your quote for details and links.

MAUI - Cancellation Fees:
If cancelled 21 days prior to pick up - No Fee
If cancelled 21 to 7 days prior to pick up - 20% of Gross Rental
If cancelled 6 to 1 days prior to pick up - 50% of Gross Rental
If cancelled on the day of pick up or no show - 100% of Gross Rental
If vehicle is returned early for any reason whatsoever - No Refund Available
There is no refund for late pick up or early return of vehicle

BACKPACKER.Cancellation.Fees
If cancelled 25 days prior to pick up - No Fee
If cancelled 24 to 6 days prior to pick up - 15% of Gross Rental
If cancelled 5 days prior to pick up - 40% of Gross Rental
If cancelled on the day of pick up or no show - 100% of Gross Rental
If vehicle is returned early for any reason whatsoever - No Refund Available
There is no refund for late pick up or early return of vehicle.

BRITZ - Cancellation Fees:
If cancelled 21 days prior to pick up - No Fee
If cancelled 21 to 7 days prior to pick up - 20% of Gross Rental
If cancelled 6 to 1 days prior to pick up - 50% of Gross Rental
If cancelled on the day of pick up or no show - 100% of Gross Rental
If vehicle is returned early for any reason whatsoever - No Refund Available
There is no refund for late pick up or early return of vehicle

APOLLO Cancellation Fees
If cancelled 25 days prior to pick up - No Fee
If cancelled 7 to 24 days prior to pick up - 20% of Gross Rental (minimum $250)
If cancelled less than 7 days prior to pick up - 50% of Gross Rental
If cancelled on the day of pick up or no show - 100% of Gross Rental
There is no refund for late pick up or early return of vehicle.

TRAILMASTER
Cancellation Fees If cancelled 25 days prior to pick-up No fee
If cancelled from 24 to 7 days prior to pick-up 15% of gross rental
If cancelled 6 days or less prior to departure 40% of gross rental
Or a No show 80% of gross rental If vehicle is returned early for any reason whatsoever, no refund available.
In the event of ANY cancellation, the deposit will not be refunded.

KEA Cancellation Fees
Fees in Percentage of Gross Rates if: 25 days before pick-up = No fee
24 days to 6 days before pick-up = 15%
5 days to 0 days and no show = 50%
If vehicle is returned early = No Refund available

AROUND AUSTRALIA MOTORHOMES Cancellation fees
Other than for exceptional circumstances and then entirely at the discretion of the manager, the following fees will apply for cancellations after confirmation of booking (payment of deposit):
A $75.00 cancellation administration fee will apply to all cancellations.
Within 30 days prior to pick-up: $500.00
Within 7 days prior to pick-up: 50% of rental cost
If cancelled on day of pick-up or a No Show:
No refund available If vehicle is returned early: No refund available

4WD Hire (Brisbane) Cancellation Fees
The following fees will apply to cancellations.
If cancelled 25 days prior to vehicle collection: No Fee
If cancelled 24 - 7 days prior to vehicle collection: 15%
If cancelled 6 days prior to vehicle collection: 50%
If cancelled less than 6 days: 100% and/or at the discretion of Four Wheel Drive Hire Service

Problems: In the event that a client has a complaint about any of the travel arrangements, they must advise the relevant supplier at the time in writing and inform Australia 4 Wheel Drive Rentals in writing. This will assist settlement of any grievance or complaint. We at Australia 4 Wheel Drive Rentals will do our utmost to resolve any discrepancy that arises.

Any disputes including over the quality, fitness and condition of the product, depot staff, supplier delays, rental rates, security excess and bonds, associated fees and road restrictions is between the client and the product supplier solely and as such Australia 4 Wheel Drive Rentals cannot be held liable for any problem with the product supplied or not supplied and the suppliers service.

" The Australia 4 Wheel Rentals Group will NOT accept responsibility for any/the loss or damage or injury caused to any passenger. Australia 4 Wheel Drive Rentals accepts no liability for personal injuries and losses.

It is the client's responsibility to choose a trip within their capabilities.

We strongly recommend that full travel insurance and including cancellation insurance be obtained. Unforeseen circumstances that may require you to cancel travel plans can be very costly. In most cases this will incur a heavy penalty including total loss of the hire costs paid by you. Please ensure you have adequate travel insurance cover.

You must read the Terms and Conditions that apply to the vehicle you wish to hire prior to making a reservation request. Any cancellation fees that apply are additional to the forfeiture of the reservation deposit amount.

When calculating the cancellation fees the calculations will be based on the full listed retail rate of the supplying rental company and not on any discounted rates.

This site is provided by Australia 4 Wheel Drive Rentals www.australia4wheeldriverentals.com and it's websites for the purpose of providing travel information and bookings with selected travel agents and tour operators. By booking or purchasing any service offered on this site an agreement arises between www.australia4wheeldriverentals.com and it's websites(us) and the customer(you).

Other Conditions: Australia 4 Wheel Drive Rentals, it's directors or employees as operator or agent finalises all arrangements for these products on the express condition that it shall not be held liable for any injury, loss, accident, delay or irregularity which may be occasioned either by reason of any defect in any vehicle, vehicle delay, vessel or equipment or by Acts of God or through the acts of default of any company or person engaged in conveying the passengers or in carrying out our arrangements of the tours or otherwise in connection herewith. Australia 4 Wheel Drive Rentals reserves the right to change any of the facilities, services or prices described in the information provided.

Australia 4 Wheel Drive Rentals accepts no liability for any action or activity undertaken by the client arranged independently or Australia 4 Wheel Drive Rentals while on holiday. Australia 4 Wheel Drive Rentals shall not be liable to compensate clients for associated expenses incurred as a result of their booking. No refund will be made for any unused services that are included in the price.

We reserve the right to levy any government increase in local taxes that may be introduced after the publication of this site, however, we will make every effort to ensure that you are notified of any of these matters either prior to your booking or as soon as practicable after we have knowledge of such increases.

Rates and Conditions quoted in our brochures and/or documentation are subject to change without notice.

Please note that the car, campervan and motorhome rental companies reserve the right at their sole discretion to restrict vehicle movements in certain areas due to adverse road or weather conditions.

Once the hire commences: When the rental vehicle has been collected, and the rental agreement contract between the hirer and the rental supply company has been signed, the Terms and Conditions contain within that contract apply in full.

Should there be any amendment such as shorten or extend the hire once the hire has commenced, the hirer will have to deal directly with the rental supply company and not us at Australia 4 Wheel Drive Rentals, though we will assist to provide some general informations. Any decision made will be between you and the rental supply company.

A booking shall be kept in the name of the orginal named person/s on the booking at all times and not changed. The same person/s shall be responsible for paying for the security bond and signing the vehicle suppliers rental agreement contract at pickup.

All main and extra drivers must be present at the pickup of the rental with a valid drivers licence as per the suppliers terms.
